This Privacy Policy describes how APEX Nerd Labs (“we,” “us,” or “our”) collects, uses, stores, and protects personal information when you:

  • Book an audit, workshop, or consultation
  • Receive SMS or email messages from us
  • Engage our consulting or implementation services
  • Interact with us through any other channel

2. Information We Collect

Information You Provide Directly

  • Name, email address, phone number, and business name when you book or contact us.
  • Business details, workflows, tool names, and operational information shared during an assessment, workshop, or consultation.
  • Payment information processed through Stripe (we do not store this data).
  • Communication content from calls, emails, and messages.

Information Collected Automatically

  • Browser type, device type, IP address, and referral source via standard analytics.
  • Pages visited and time spent on apexnerdlabs.com.

Information From Third Parties

  • Cal.com provides booking confirmations and scheduling data when you book through our calendar links.
  • Stripe provides payment processing data. We do not store your card information.
  • HighLevel (GoHighLevel) provides CRM and SMS communication data when you interact via our messaging systems.

3. How We Use Your Information

  • Service delivery: To perform your audit, workshop, or consulting engagement.
  • Communication: To confirm bookings, send appointments, and follow up on engagements.
  • Business improvement: To understand which services help clients most, improve our methodology, and build better training materials.
  • Marketing (with consent): To send updates about new services, workshops, and resources. You may opt out at any time via the links in our emails or by replying STOP to SMS messages.
  • AI processing:When performing assessments or generating deliverables, we may use AI tools to assist in analysis. Your business data shared during an engagement is processed by these tools strictly for the purpose of delivering the engagement's output. We do not train AI models on your confidential business data.

4. How We Protect Your Information

  • Data is stored in commercially reasonable secure systems (encrypted at rest and in transit).
  • Payment data is handled exclusively by Stripe, a PCI-compliant payment processor.
  • We limit access to your information to ourselves and, when needed for an engagement, to our direct service providers.
  • We do not sell your personal information to third parties.

5. Data Sharing and Third Parties

We share information with the following service providers, only to the extent necessary for the purposes described above:

  • Stripe: Payment processing.
  • Cal.com: Scheduling and calendar management.
  • HighLevel (GoHighLevel): CRM, email delivery, and SMS messaging.
  • AI service providers: When we use AI tools for analysis or content generation during engagements, data is processed by these providers in accordance with our instructions and our Terms of Service with them.
  • Analytics: Basic website analytics providers.

We will not share your personal information with any other third party without your consent, except as required by law.

6. A2P Messaging and SMS Compliance

If you receive SMS messages from APEX Nerd Labs:

  • How you opt in: SMS consent is collected through the chat widget on apexnerdlabs.com. When you start a conversation in the widget, you are asked to provide your phone number and to agree to receive text messages before any SMS is sent. Consent is optional, is never a condition of purchasing our services, and is not bundled with agreement to this Privacy Policy or our Terms of Service.
  • We obtain your explicit consent before sending marketing SMS.
  • Transactional messages (booking confirmations, appointment reminders) are sent because you have a service relationship with us.
  • Message frequency: Message frequency varies based on your engagement with us and any active booking.
  • Cost:Message and data rates may apply. We do not charge for messages; your mobile carrier’s standard rates apply.
  • You may opt out of all messages at any time by replying STOP. Transactional messages related to an active engagement may continue until that engagement concludes.

  • Your phone number is used only for scheduling communication, engagement updates, and optional marketing messages. We do not sell or rent phone numbers.
  • No third-party sharing for marketing: Mobile opt-in data and consent records are never shared with or sold to third parties for their own marketing purposes. They are shared only with the messaging providers that deliver the messages on our behalf.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Request access to the personal data we hold about you.
  • Request correction of inaccurate data.
  • Request deletion of your data (subject to legal and contractual obligations).
  • Object to or restrict certain processing.
  • Opt out of marketing communications at any time.

8. Data Retention

We retain personal data for as long as necessary to:

  • Fulfill the engagement it relates to.
  • Comply with legal and tax obligations.
  • Defend against legal claims.

Marketing and newsletter contact data is retained until you opt out. Booking data from completed engagements is retained for a minimum of 3 years for business record-keeping, after which it is reviewed for deletion.

9. Cookies and Tracking

Our website may use cookies for:

  • Dark mode preference (stored locally in your browser).
  • Website analytics (anonymized traffic data).
  • Chat widget functionality (HighLevel chat widget).

You can control cookies through your browser settings. Disabling cookies may affect some site functionality.

10. Children's Privacy

Our Services are directed at adults operating or advising small businesses. We do not knowingly collect personal information from children under 16. If you believe we have collected such data, contact us immediately.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Changes are effective immediately upon posting at apexnerdlabs.com/privacy. We will notify you of material changes via email if we have your contact information on file.
